These Terms & Conditions (“Terms”) govern your booking and travel arrangements with Nikita Holidays (“we”, “us”, “our”). By making a booking, paying any deposit, or using our services, you agree to these Terms.
1. Definitions
Client / You / Your: The person or persons named in the booking who accept these Terms on behalf of all persons in the party.
Booking: A reservation for travel services such as tours, accommodation, transfers, etc.
Services: All components of the travel/tour package including transport, accommodation, meals, sightseeing, guides, etc.
Supplier: Any third-party (hotel, transport operator, guide, etc.) providing part of the services.
Package: The entire travel arrangement offered by us, including all included elements (transport, accommodation, meals etc.).
2. Contract & Booking
- A contract between you and Nikita Holidays comes into force when we issue a booking confirmation following receipt of the required deposit, fully completed booking form, and your acceptance of these Terms.
The person making the booking must be over 18 and legally competent to enter into contracts, and must be authorised to do so on behalf of the party (if more than one person).
You must supply accurate and complete information as required (names, passport/ID info, any special requirements). Errors may affect your travel and may result in additional costs.
3. Payments
- Deposit: Upon booking, a deposit of [___]% of the total package cost is required to secure your booking.
- Balance Payment: The remaining amount must be paid [___] days before the departure date. If booking is made within [___] days of departure, full payment is due at time of booking.
- Payment Methods: Payments can be made via bank transfer, credit/debit card, UPI / online payment gateway, or other methods we accept. Any transaction fees or charges imposed by banks or payment processors may be borne by you.
- Late Payment: If the balance is not received by the due date, Nikita Holidays reserves the right to cancel the booking, retain the deposit, and apply cancellation charges as per our cancellation policy.
4. Cancellation & Refund Policy
- By Client: If you cancel, you must inform us in writing. The following cancellation charges will apply:
- By Us / Suppliers: We may need to cancel or alter your booking due to events beyond our control or supplier issues. Where possible, we will offer alternative arrangements or a full refund of amounts you have paid. Nikita Holidays is not liable for additional costs incurred by you (e.g., flights, visas) due to such cancellations.
5. Changes to Booking by Client
- Any request to change the booking (dates, itinerary, accommodation, number of people, etc.) must be made in writing.
- We will try to accommodate changes but cannot guarantee availability or that the change is feasible. Changes may incur additional costs (supplier fees, fare differences, etc.).
- Changes made close to departure may incur surcharges, including possible additional fees.
6. Changes by Nikita Holidays / Itinerary Alterations
- Occasionally, we may have to alter the itinerary, accommodation, transport or other services due to safety, regulatory, weather, or operational reasons beyond our control.
- We will inform you at the earliest possible time. We aim to provide alternatives of similar standard.
- Nikita Holidays does not accept responsibility for loss, damage or additional costs arising from such changes, provided reasonable efforts are made to minimize any inconvenience.
7. Supplier’s Terms & Third-Party Services
- Some parts of your trip (hotel stays, transport, guides, restaurants etc.) are provided by independent contractors (“Suppliers”). While we carefully select them, we are not responsible for their acts or omissions.
- Additional terms, rules or conditions imposed by suppliers will apply in addition to these Terms.
8. Passport, Visa, Health & Insurance Requirements
- It is your responsibility to ensure you hold valid documents (passport, visa, permits etc.) required for your destination(s), valid for the required period (including any margin required by authorities).
- Any required vaccinations, health certificates etc. for destinations/suppliers must be procured by you.
- Travel insurance covering medical expenses, trip cancellation, loss/theft of baggage etc. is strongly recommended, and may be required on certain tours.
9. Health and Special Requirements
- If you have any medical condition, disability, allergy, dietary requirement, or other special requirement, you must inform Nikita Holidays at the time of booking.
- We will endeavour to accommodate your requirements but cannot guarantee that all needs can be met. Additional costs may apply.
- You are responsible for taking any prescribed medication etc., and for maintaining your health and fitness for the travel involved.
10. Liability & Disclaimer
- Nikita Holidays’ liability is limited to providing the services included in your booking as specified in the itinerary/confirmation.
- We are not liable for losses, injuries, damages, delays, accidents or any other loss caused by:
- Acts or omissions of third-parties not under our control (e.g. hotels, carriers, other travellers, local authorities).
- Events beyond our control (force majeure) such as natural disasters, pandemics, strikes, political instability.
- Your own failure to follow legal requirements, supplier’s rules, health/safety instructions.
- Circumstances that were not foreseeable at the time of booking.
Any claim for negligence, breach or refunds must be notified to us within [___] days after the trip ends. Failure to do so may affect the claim.
11. Delays, Missed Departures & No-Shows
- You must arrive at designated departure points on time. If you miss transport due to your own lateness, we are not responsible for arranging alternate transport nor for refunds for unused services.
- If flight or transport delays occur beyond our control, we will assist where possible but cannot be held liable for costs incurred by you.
12. Conduct & Behaviour
- You agree to act in a manner that does not endanger, distress, or cause trouble to other travellers, or suppliers.
- If your behaviour is disruptive, illegal, or harmful and forces us or suppliers to refuse continuing service, we may terminate parts or all of your services without refund.
13. Prices, Surcharges & Taxes
- All prices quoted by Nikita Holidays are in Indian Rupees (INR) unless otherwise stated and include what is explicitly listed in the package (accommodation, meals, sightseeing etc.).
- Prices do not include optional extras, personal expenses, gratuities, visas, taxes not specifically included, etc.
- We reserve the right to adjust the price in case of:
- Rise in transport costs (fuel, airfare, fuel surcharges), or
- Currency fluctuations, or
- Increase in government taxes, fees or regulations
- Any such changes will be communicated before you make full payment, where possible.
14. Intellectual Property & Privacy
- All content on our website, brochures, itineraries etc., are owned by Nikita Holidays or used under licence. You may not reproduce or use them without permission.
- We collect and use your personal data (name, contact details, passport/ID info, etc.) for purposes of arranging your travel, fulfilment of service with suppliers, communication, legal compliance etc.
- Your data may be shared with suppliers (hotels, transport, guides etc.) strictly on a need-to-know basis.
- We are committed to protecting your privacy and handling your data in accordance with applicable laws.
- You consent to receiving confirmations, notices, communications from us (by email, phone, SMS etc.).
15. Complaints Procedure
- If something is unsatisfactory during the trip, please inform our local representative or supplier immediately so there is opportunity to correct it.
- After returning, any complaints should be put in writing and sent to us at sales@nikitaholidays.com within [___] days of the end of the trip. Give full details so we can investigate.
- We will respond to your complaint within [___] days of receipt.
16. Force Majeure
- We are not liable for any failure or delay in performing our obligations under these Terms where such failure or delay is caused by circumstances beyond our reasonable control, including (but not limited to) natural disasters, pandemics, civil unrest, war, strikes, government action, extreme weather, etc.
17. Governing Law & Jurisdiction
- These Terms are governed by the laws of India.
- Any dispute between you and Nikita Holidays arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Agra, Uttar Pradesh, India.
18. Severability & Entire Agreement
- If any provision of these Terms is held invalid or unenforceable under applicable law, that provision shall be severed from these Terms and the remaining Terms shall continue in full force.
- These Terms (and any documents referred to in them) constitute the entire agreement between you and Nikita Holidays in respect of your booking, and supersede any previous communications, representations or agreements, whether oral or written.
